General Terms and Conditions (GTC)
GENERAL TERMS AND CONDITIONS (GTC)
1. Scope
These General Terms and Conditions apply to all contracts between DJ Dido (Oleksandr Khomutov, Zita-Kaiser-Str. 9, 79106 Freiburg im Breisgau, Germany) — hereinafter referred to as the “Provider” — and its customers in the areas of DJ and music services, event planning, artist booking and event technology, unless otherwise agreed in writing.
2. Services
The type and scope of the services shall be determined by the respective quotation and/or contract.
Partial performance is permitted where reasonable.
The Provider may engage equivalent subcontractors or other persons assisting in the performance of the contract.
3. Formation of Contract
The contract is concluded upon written confirmation of the quotation by the Customer, including confirmation by email, form or message.
By confirming the quotation, the Customer accepts these General Terms and Conditions.
4. Prices, Payments and Additional Costs
All prices are final prices in accordance with Section 19 of the German VAT Act (UStG) (small-business regulation — VAT is not shown separately).
Unless otherwise agreed:
– 30% deposit upon booking, payable within 7 days,
– the remaining balance is due no later than the day of the event, either in cash or in advance by bank transfer.
The Customer shall bear the following additional costs:
– travel expenses for the outward and return journey as stated in the quotation, or €0.35 per kilometre from Freiburg im Breisgau,
– parking and toll charges,
– accommodation for assignments ending late at night or at a distance of more than 100 km, where appropriate, in accommodation of at least a reasonable mid-range standard,
– reasonable meals and non-alcoholic beverages for the duration of the assignment.
In the event of late payment, statutory default interest pursuant to Section 288 of the German Civil Code (BGB) shall apply: the base interest rate plus 5 percentage points for consumers and plus 9 percentage points for business customers.
The Customer shall also reimburse any necessary reminder and debt collection costs.
5. Changes, Waiting Times and Overtime
Extensions of the agreed performance time, alterations requested by the Customer and waiting times for which the Customer is responsible shall be charged additionally at the hourly or flat rate stated in the quotation for each commenced hour.
6. Setup, Dismantling, Equipment and Power Supply
The Customer shall ensure timely access to the event venue and provide sufficient space as well as a suitable and safe power supply.
As a general rule, a 230 V power supply with a separate 16 A circuit is required. Larger setups shall be subject to the applicable technical rider.
Connecting third-party equipment to the Provider’s equipment is prohibited unless approved in writing in advance.
Where official noise restrictions or sound limiters apply, the Provider shall adjust the volume accordingly. Claims arising solely from such required reductions in volume are excluded.
6a. Outdoor Events / Adverse Weather
In the event of rain, storms, extreme heat or cold, or comparable risks, the Provider may interrupt or terminate the performance if the safety of persons or equipment cannot be guaranteed.
In such cases, there is no general entitlement to a refund.
Any portions of the agreed performance time not yet provided may, where appropriate, be credited at the Provider’s reasonable discretion.
6b. Guest Behaviour / Safety Reasons
The Provider is entitled to immediately suspend or terminate the performance if guests, organisers or other persons behave aggressively, abusively, threateningly or are severely intoxicated, or if the safety of persons or equipment is endangered.
In such cases, there is no entitlement to a refund of the fee or any other amounts already paid.
In serious cases, the Provider may report the matter to the relevant authorities.
Any security personnel required for the event shall be arranged and paid for by the Customer.
7. Cancellation by the Customer
The Customer may cancel the booking at any time.
The following cancellation charges apply:
– up to 30 days before the event: 0%,
– 29 to 14 days before the event: 50%,
– from 13 days before the event, or in the event of non-attendance: 100% of the agreed fee.
Any deposits already paid shall be credited against the cancellation charge.
The Customer remains entitled to demonstrate that the Provider suffered a lower loss.
8. Withdrawal / Inability of the Provider to Perform
In the event of illness, accident, force majeure or other unforeseeable circumstances, the Provider may withdraw from the contract or arrange an equivalent substitute.
If the event is cancelled by the Provider without a substitute being provided, all fees already paid shall be refunded in full.
Further claims, including claims for damages or reputational damage, are excluded.
9. Liability
The Provider shall be liable for damages only in cases of intent or gross negligence.
Liability for ordinary negligence, loss of profit, indirect damages, consequential damages, reputational damage or loss of data is excluded.
Liability for injury to life, body or health remains unaffected.
The Provider accepts no responsibility for power failures, technical failures caused by third parties, internet or network-related disruptions, or official restrictions.
GEMA registrations, public-law permits and any applicable fees or levies are the sole responsibility of the organiser / Customer.
10. Customer Obligations / Protection of Equipment
The Customer shall ensure a safe setup area, suitable power supply, access for loading and unloading, and appropriate protection of the Provider’s equipment against damage and theft.
The Customer shall be liable for damage caused by the Customer, guests, employees or other persons under the Customer’s responsibility.
The Provider may claim the applicable replacement costs or replacement value for damaged or lost equipment.
11. Photo / Video Recordings and Personal Rights
Photo and video recordings made by the Provider may be used for the Provider’s own promotional purposes unless the Customer objects in writing before the event.
The Customer is responsible for ensuring that all necessary consents from persons shown in the recordings and from relevant venues or locations have been obtained.
The Customer shall indemnify the Provider against third-party claims arising from the absence of such required consent.
12. Data Protection
Personal data shall be processed exclusively for the purpose of handling and performing the contractual relationship.

13. Text Form and Severability
Any amendments or additions to the contract must be made in text form. Email is sufficient.
If any provision of these General Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
14. Applicable Law, Place of Jurisdiction and Language
German law shall apply.
Where legally permissible, the place of jurisdiction shall be Freiburg im Breisgau, Germany.
The contractual language is German.
Any translations of these General Terms and Conditions are provided for convenience and better understanding only. In the event of any discrepancy or conflict, the German-language version shall prevail.
